Workshop Agreement & Waiver
This Workshop Agreement & Waiver (the "Agreement") is entered into by and between Job Start Workshop ("Company") and the Participant ("Participant").
1. Participation & Payment: Participant agrees to pay the workshop fee in full at the time of registration. By submitting payment, Participant commits to attending the selected workshop.
2. Minors: If Participant is under 18 years of age, the parent or legal guardian registering the Participant represents that they have the legal authority to consent to the Participant's attendance and agree to the terms of this Agreement on the Participant's behalf.
3. Intellectual Property: Each party retains ownership of their pre-existing intellectual property. Company grants Participant a non-exclusive, non-transferable license to use the provided workshop materials solely for personal use. Participant may not sell, share, or distribute these materials without prior written permission.
4. Media & Likeness Release: Participant grants Company the right to record, publish, and use Participant's name, image, likeness, and testimonials in any media, in perpetuity, for any purpose (including marketing). Participant waives all claims to compensation or royalties regarding such media.
5. No Recording Policy: Participant agrees not to film, photograph, or record workshop content without express prior approval from Company. Unauthorized recording may result in liquidated damages equal to 20% of the total workshop fee, in addition to potential legal recourse.
6. Risk & Liability Waiver: Participant acknowledges that participation in the workshop may involve ordinary risks associated with travel to and from the venue, interaction with others, and participation in classroom activities. To the fullest extent permitted by law, Participant releases Company and its agents from all liability for any such injuries or losses, including those caused by the Company's negligence.
7. Confidentiality: Both parties agree to protect and not disclose the other party’s proprietary or confidential business information, processes, or trade secrets revealed during the workshop.
8. Performance & Limitation of Liability: Company makes no representation or guarantee that participation in the workshop will result in employment, interviews, promotions, improved job performance, or any other specific outcome. In the event of issues with third-party service providers, the Company’s total liability is limited to a refund of the registration fee paid by the Participant.
9. Cancellation & Refund Policy: If Participant cancels, refunds are provided based on the following notice period:
30+ days prior: 100% refund.
14 – 29 days prior: 50% refund.
Less than 14 days prior: No refund. Company reserves the right to change the venue, instructor, schedule, or classroom location when reasonably necessary.
9. Force Majeure: Company is not in breach of this Agreement if performance is prevented by events beyond its reasonable control, including, but not limited to, natural disasters, pandemics, or government orders.
10. Governing Law & Dispute Resolution: This Agreement is governed by the laws of the State of Colorado. Any disputes will be resolved in the courts of Colorado Springs. The prevailing party in any legal action shall be entitled to recover reasonable attorneys' fees and costs.
11. Entire Agreement: This document constitutes the entire agreement between the parties and supersedes all prior communications. No modification is binding unless in writing and signed by both parties.
